It is proposed to reconsider the procedure for increasing pensions and deducting the overpaid pensions.
According to the report of Modern.az, this was reflected in the “Report of the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan for 2025,” which was discussed at today's meeting of the Human Rights Committee of the Milli Majlis.
The Ombudsman makes the following proposals in the field of pensions:
- when increasing the minimum amount of the labor pension, to increase all pension amounts previously assigned up to that increase proportionally or by a specified amount (or percentage) regardless of their amount;
- considering that the overpayment of the labor pension and the supplement to the labor pension does not occur due to the pensioner's fault, that this situation is related to functional deficiencies in the activity of the relevant institution, and that subsequent deductions worsen the social situation of the labor pensioner, to reduce by 1 year the period stipulated in Article 39.1 of the "Labor Pensions" law for deducting the amount of the overpaid labor pension and its supplement from the pension (currently, it is envisaged that this deduction be made for the last 3 years);
- to include persons with at least 35 years of work experience in civil service in the list of persons entitled to labor pensions under concessional conditions and to make appropriate amendments to the "Labor Pensions" law in this regard;
- to replace the two-year period stipulated in clause 1.2 of the "Self-employment Organization Rules" approved by the Cabinet of Ministers' Decision No. 168 dated May 13, 2020, regarding unemployed persons close to pension age with a five-year period to increase efficiency in ensuring the employment of such persons, as well as to make amendments to this clause regarding the inclusion of persons with three or more underage children for strengthening the social protection of large families;
