According to Medianews.az, this issue is reflected in the draft amendments to the Labor Code and the "Law on Guarantees for Gender (Men and Women) Equality," which were discussed at today's meeting of the Milli Majlis Committee on Labor and Social Policy.

The project improves the main responsibilities of the employer in the field of labor relations.

According to the project, regardless of gender, employers must create the same working conditions for employees engaged in the same job, ensure equal pay for employees performing the same or equivalent different work, not apply different disciplinary measures to employees for the same violation, and take necessary measures to prevent discrimination and sexual harassment based on gender.

According to the document, the employer is obliged to pay equal wages to employees performing the same or equivalent different work, regardless of gender. The equivalence of work will be determined by the employer taking into account working conditions, the nature of labor function, and the tariff-qualification characteristics specified in the currently effective unified tariff-qualification reference books.

It is noted that in accordance with the International Labour Organization Convention No. 100 and the European Social Charter, equal pay must be fully ensured for men and women for work of equal value. However, the current legislation applies this principle only within the framework of "same or similar jobs" and does not cover the broader concept.

One of the main reasons necessitating the relevant amendments to the legislation to ensure gender equality in wages in the country arises precisely from these mentioned international commitments.

It is stated that the objective evaluation of work of equal value will be determined by employers taking into account working conditions, the nature of labor function, and the tariff-qualification characteristics specified in the currently effective unified tariff-qualification reference books.

Also, according to the proposed amendment to the "Law on Guarantees for Gender (Men and Women) Equality," employers must pay equal wages to employees performing the same or equivalent different work, regardless of gender. The equivalence of work will be determined by the employer in accordance with the requirements of the Labor Code, taking into account working conditions, the nature of labor function, and the tariff-qualification characteristics specified in the currently effective unified tariff-qualification reference books.
