Today, the Baku Court of Appeal replaced the detention order with house arrest for Ilduza Hajiyeva, a TikToker nicknamed "Arzum 9999", who is accused of causing a fatal traffic accident.
According to the decision, during the period of house arrest, Ilduza Hajiyeva is prohibited from using social networks, except for communicating with family members abroad via WhatsApp.
Medianews.az reports that house arrest is a restraining measure. Until now, there has been no information in the country about any persons under such restraining measures being prohibited from using social networks.
From this perspective, the decision of the Baku Court of Appeal regarding Ilduza Hajiyeva is the first publicized court decision in Azerbaijan's judicial practice that imposes a separate restriction on the use of social media.
Not all court decisions are disclosed to the public, and it is possible that similar restrictions have been applied in other cases not known to the public. However, if such a case has not occurred until now, then the prohibition on using social networks during Ilduza Hajiyeva's house arrest is a precedent in Azerbaijan's judicial practice in general.
In any case, this is the first known court practice to the public and media.
It should be noted that Ilduza Hajiyeva was sentenced to 5 years and 2 months of imprisonment on July 2 by the Khazar District Court. However, this sentence has not yet come into force because the case is appealed to a higher court.
On July 2, the Khazar District Court not only issued the imprisonment sentence but also ordered a detention measure against Ilduza Hajiyeva, and she was detained that day not under the 5 years and 2 months imprisonment sentence which had not yet come into force, but due to the pre-trial detention measure.
