Penalties are increased for cases where the act of organizing or hosting gambling games is repeatedly committed, where minors are allowed to participate in gambling games, where a considerable, large, or particularly large amount of income is obtained, and other similar cases.
According to Medianews.az, the aforementioned issue has been reflected in the draft amendments proposed to the Criminal Code.
The draft states that when committed virtually, including through the internet network, mobile communication network, social network platforms, other electronic communication means, as well as internet and mobile telecommunications applications or other technology-based platforms;
when committed by allowing minors to participate in gambling games;
when committed by a group of persons who are previously in collusion;
when committed with obtaining a considerable amount of income, the penalty is restriction of freedom for a term of two to four years or imprisonment for the same term, along with a fine of up to twice the amount of income obtained as a result of the crime.
Also, when committed by an organized group or criminal association (criminal organization), or when a large amount of income is obtained, the penalty is restriction of freedom for a term of three to five years or imprisonment for the same term.
While the current sanction stipulates the amount of the fine within a specific range (from 10,000 to 15,000 manats), under the draft the fine will be determined as up to twice the amount of income obtained as a result of the crime. Moreover, stiffening of penalties is envisaged for the organization or conducting of gambling games, as well as for repeated acts of organizing or hosting gambling games, for allowing minors to participate in gambling, for obtaining considerable, large, or particularly large amounts of income, and other related cases.//Oxu.Az
