The son of former national security minister Eldar Mahmudov, Anar Mahmudov, is trying to seize legally owned properties belonging to various citizens.
Recall that during the period Eldar Mahmudov was the head of the Ministry of National Security, he coerced businessmen who were constructing a residential building owned by “Dolçasaray” LLC located in Baku to write legally invalid contracts for several apartments in his son's name.
However, after Eldar Mahmudov himself and the organized criminal group he established at the Ministry of National Security were exposed, the management of the construction company refused to hand over the apartments registered in Mahmudov's name.
A group of citizens then paid the mentioned construction company to purchase apartments for themselves and renovated them.
Although those individuals have been living in their registered apartments for more than 10 years, due to a secret collaboration between the Mahmudovs, the leadership of the Baku Court of Appeal, and Judge Mammad Mammadov, they are faced with the risk of being deprived of their legal property.
Musavat.com reports that during an investigation by Gununsesi.info on the matter, it was revealed that although the first-instance court issued a decision protecting the citizens' property rights, subsequently Judge Mammad Mammadov at the Baku Court of Appeal issued a ruling contrary to the Constitution and laws.
It turned out that Anar Mahmudov did not make any payments to the company for purchasing those apartments from the construction company.
Specifically, the document submitted by Anar Mahmudov to the court lacks any figures or receipts regarding the value of the apartment or any payment.
This fact is sufficient to confirm that the apartments were obtained through intimidation by Eldar Mahmudov.
Even if the Mahmudovs had purchased apartments in that building, the court obligation here should be placed on the construction company, not on the other citizens who are bona fide buyers.
But Judge Mammad Mammadov, disregarding the laws, wants to deprive the citizens of their property.
In a statement to the site, the citizens whose property rights have been infringed by Mammad Mammadov say that after the decision, the judge sent a message saying “this matter is not mine,” indirectly shifting responsibility to the chairman of the Baku Court of Appeal, Mubariz Akbarov.
Currently, citizens who are preparing a cassation complaint to the Supreme Court have expressed their confidence that a just decision will be made at the final judicial instance.
They also declared that they will fight for the initiation of disciplinary proceedings against Judge Mammad Mammadov by the Judicial-Legal Council.
The fact that Mammad Mammadov is trampling on the laws and lobbying on behalf of Anar Mahmudov, who has long evaded investigation under the “Ministry of National Security Case” conducted at the General Prosecutor's Office, is also a subject for separate investigation.
