"When the proposal to eliminate the permit requirement for removing greenery that obstructs agriculture is accepted, it will also apply to fines that were written but not enforced due to this violation."
Medianews.az reports that these statements were made by Mohammad Baziqov, head of the Economic Legislation Department of the National Assembly, during today's session of the Parliamentary Committee on Natural Resources, Energy, and Ecology while discussing the proposed amendments to the Law "On the Protection of Greenery."
"According to the 'Constitutional Law on Normative Legal Acts' and the Criminal Code, there is retroactive effect in cases where responsibility is mitigated. In other words, if an act ceases to be a criminal or administrative offense, then fines that were unenforced for previous periods should be canceled," he said.
Recall that the list of cases where permission is granted for the removal of greenery is being expanded. According to the draft, permission will be given for removing greenery in agricultural lands under targeted cultivation, such as arable land and perennial plantations, if the greenery obstructs agricultural activity.
While discussing this matter, Sadiq Gurbanov, chairman of the Parliamentary Committee on Natural Resources, Energy, and Ecology, touched upon this issue and asked the question: "Will the cancellation of previous fines be envisaged after the law is adopted?"
