Attention to those who buy phones with a warranty — This is how they deceive you

When a defective product is sent for repair, misconceptions about how this period affects the warranty time cause legal problems for consumers. We have received complaints about this issue in our editorial office.

So, according to the legislation, how should the warranty period be affected while the product is under repair, and how should the consumer's rights be protected?

Regarding the topic, lawyer Turan Abdullazade told Demokrat.az that some sellers deceive consumers about the warranty period of the product:

"When a defect is detected in the product and it is sent by the seller for repair, for example, if the repair lasted two months, they include that two-month period in the warranty period. However, this is completely illegal. According to clause 6.4 of the "Law on Protection of Consumer Rights," while warranty repairs are being carried out, the warranty period of the product is extended by the duration it is under repair. For example, if the product has been under repair for two months, the warranty period is considered extended not just to one year but to one year and two months."

The lawyer stated that when the product is completely replaced, the warranty period should be recalculated from the day of replacement:

"Suppose a product breaks down after ten months, the seller repairs it for two months, then returns it to the consumer. The consumer uses it and a defect appears again. At this point, the seller claims that the one-year warranty period has been provided already and with the two months of repair, that totals twelve months. However, this is illegal because the time under repair is not included in the warranty period, and the warranty period flow stops during that time. Therefore, the consumer retains the right to an additional warranty for the duration of the repair," he noted.
