Wedding, mourning, social media... - Every step of Rəqsanə will be followed

After the selected preventive measure against Rəqsanə İsmayılova was replaced with house arrest, a number of questions interest the public. One of the questions is whether the decision of the Sabunçu District Court hinders her activities as a singer.

"The release of the accused person to house arrest necessarily requires an agreement between her and the injured party on certain issues. Evidence regarding this must be presented to the court. Additionally, the accused person's health, permanent place of residence, public prominence, and, among other things, the fact that they do not interfere with the course of the investigation are grounds for release to house arrest."

This was stated by lawyer Ramil Süleymanov to "Yeni Sabah".

According to him, the court may also impose certain obligations on the accused:

"These obligations include not leaving the area of residence beyond certain limits, maintaining the technical device assigned to them. Also, during the house arrest period, not influencing the course of the investigation by any means, and not affecting the injured parties or witnesses are among the requirements of house arrest."

Ramil Süleymanov emphasized that the court's decision may prohibit the person's participation in certain events:

"At the same time, the court may impose additional obligations: the person cannot participate in mass events, weddings, funerals, rallies, demonstrations. By the court's decision, the person released to house arrest may be prohibited from using public influence mechanisms that could hinder the investigation - speaking in mass media, sharing on social networks."

The lawyer noted that the court also determines the limits within which the person can move during house arrest:

"The court decides within what boundaries the person released to house arrest can leave their home. There is no specific decision about this in the legislation. For example, these limits can be the area of the district they live in, the city of Baku, or the Absheron Peninsula.

The bracelet on the accused person directly shows which territorial boundaries they can move within.

At the same time, by submitting a justified application, the accused person can leave their city of residence. For a certain period, they can leave their city and return.

There is no necessary requirement about the specific cases in which they can leave; simply submitting a justified application is the duty of the person released to house arrest."

It should be recalled that Rəqsanə İsmayılova, born in 1979, was arrested on August 16. She was charged under Article 178.4 of the Criminal Code (fraud causing particularly large damage). The singer is accused of embezzling gold jewelry worth 35,000 manats and 520,000 dollars in cash from 2 people.
