Staying in garden houses in Germany is therefore prohibited.

In Germany, the concept of "rules and order" is so important that even camping overnight in summer gardens is prohibited by law. According to experts, this has both legal and social reasons.

National.Az reports that small garden plots called "Kleingarten" in Germany are mainly used for relaxation and growing vegetables and fruits. However, living or staying overnight here is strictly forbidden. According to the Federal Small Gardens Act, at least one third of each plot must be allocated for agricultural purposes. These places are not considered residential zones but recreational areas.

Urban planning expert Hans-Jörg Schulz said about this: "These gardens are not intended for living. Since they are not connected to heating, sewage, and water systems, staying here is both dangerous and illegal."

Reasons for the ban

Legal status

"Kleingarten" plots are officially registered not as residential places but as recreational zones. Therefore, spending the night here is considered "unauthorized settlement."
If inspectors find anyone staying overnight in the garden, that person may face a warning, a fine, or revocation of their garden usage rights.

Tax and registration rules

Population and residential addresses are precisely registered in Germany. Authorities do not want people to turn summer gardens into cheap "permanent residences."
Schulz notes: "Such overnight stays cause confusion in the tax system and are clearly prohibited by law."

Neighborhood peace and ecological order

Many garden cooperatives are located near residential neighborhoods. Permanently staying there could cause noise, garbage, and parking problems.
For Germans, the concept of "peace and order" is as important as private property. Therefore, garden associations can file collective complaints against rule violators.

A part of German culture

Experts believe that lifting this ban is unrealistic. Because "Kleingarten" is considered a traditional cultural form preserving the balance between city life and nature in Germany.

Schulz explains this as follows: "If overnight stays were allowed here, these green areas would quickly turn into illegal residential places."
